MOTORCYCLE RENTAL TERMS AND CONDITIONS
These terms and conditions are intended to regulate the contract to be established between the motorcycle rental company QNP Xperiences Unipessoal, Lda, hereinafter referred to as QNP Xperiences and the user who rents motorcycles, hereinafter referred to as the Customer.
The conditions are general and QNP Xperiences reserves the right to make specific changes, which will be set out in writing.
QNP Xperiences holds Administrative Permit no. 400902 issued by the Mobility and Transport Institute (IMT), for the activity of renting passenger vehicles without a driver (rent-a-car).
1. OBJECT OF THE CONTRACT
The object of the contract is the temporary use of a QNP Xperiences motorcycle by the Customer. QNP Xperiences declares that to the best of its knowledge the rented motorcycle is in a safe condition and free from faults or defects that affect its safe operation for normal use.
2. CUSTOMER’S AGE AND MINIMUM EXPERIENCE
The customer must be over 25 years of age and have at least five years experience of riding a motorcycle of a similar weight and power to the one they are going to use.
3. LIMITED KILOMETERS
The daily kilometer limit is 400 km per day. Each kilometer over the 400 km limit will be charged at a rate of 0.45 € per kilometer.
4. MINIMUM HIRE PERIOD
From Monday to Friday, the minimum hire period is one day (24 hours). During weekends, the minimum hire period is 2 days.
The motorcycle may not be used outside mainland Portugal unless authorised in writing by QNP Xperiences.
5. PRICES AND BOOKINGS
The rental price is valid after confirmation of the reservation by QNP Xperiences and payment of 50% of the total cost of the rental. The remaining 50 per cent will be paid when the rental begins.
In addition to the chosen motorcycle, the rental price also includes the motorcycle’s own damage insurance, a luggage bag solution, GPS navigation equipment and all applicable legal fees.
In addition, QNP Xperiences will provide vehicle identification equipment for passage without stopping at the respective toll gantries on the national road network (Via Verde).
The Client is fully responsible for any costs arising from fines, fuelling, tolls or other items not described in the previous paragraphs.
All our motorcycles have an insurance which covers all amounts relating to damage to the hired vehicle and damage to third parties, above the excess contracted, in accordance with the general and specific conditions established by the Insurance Company contracted by QNP Xperiences.
6. AVAILABILITY OF THE MOTORCYCLE
QNP Xperiences undertakes to ensure the availability of the rented motorcycle for the duration of the rental.
If, due to unforeseeable circumstances, it is not possible for QNP Xperiences to provide the Customer with a motorcycle of similar characteristics to the motorcycle booked, QNP Xperiences will reimburse the rental price in full.
7. CANCELLATION
If the Customer cancels their booking thirty or more days before the start date of the rental, QNP Xperiences will refund half of the amount already paid by the Customer.
If the cancellation occurs less than thirty days before the start of the rental, there will be no refund.
If the cancellation is partial, i.e. if the customer wishes to cancel only a few days of their rental period, the same cancellation policy will apply to the cancelled days.
8. COLLECTION AND RETURN
Pick-ups and returns will be made at QNP Xperiences premises, located at Bela Vista Office, Estrada de Paço de Arcos, n.ºs 66 – 66A, 2735-308 Cacém, during the following hours: Monday to Friday from 9.30 am to 6:00 pm.
Picking up and returning the bike during the weekend and public holidays is subject to confirmation and scheduling of a specific time and is charged at 50€ per bike and per service (pick-up or return).
There is a tolerance of 30 minutes in relation to the agreed time. After this period, delays are subject to an ancillary charge of 15€ per hour of delay.
9. EXTENSION OF HIRE
Hire ends on the day, time and place established in the terms of the contract.
If the Customer wishes to extend the hire period, they must contact QNP Xperiences at least 24 hours in advance.
QNP Xperiences may or may not authorise the extension.
If QNP Xperiences does not authorise the extension and the Customer does not return the motorcycle on the established day, time and place, the disappearance of the motorcycle will be reported to the authorities and punished civilly and criminally.
10. RESPONSIBILITY OF QNP XPERIENCES
QNP Xperiences must deliver the motorcycle in a technically correct and safe condition.
The Customer must also receive the vehicle’s documents and the accessories they have rented.
QNP Xperiences must check for and accept any existing damage that is set out in writing on the damage form as part of the handover procedure.
If, through no fault of the Customer, any repairs are necessary during the rental period in order to ensure the operation or proper functioning of the motorcycle, the Customer must obtain QNP Xperiences consent before carrying out the repairs.
Other claims are excluded, regardless of any legal reason, unless the loss or damage to the Customer is attributable to gross or wilful negligence on the part of QNP Xperiences.
11. CUSTOMER’S LIABILITY
The Customer is responsible for ensuring that they are legally entitled to drive a motorcycle, in accordance with the legislation in force in Portugal and point 2 of these Terms.
The Customer is responsible for all fines and legal charges for traffic irregularities or other offences during the period in which they rent the motorcycle.
QNP Xperiences will charge the Customer an administrative fee of €40 for processing any fine or irregularity and is obliged to communicate to the authorities the identity and other information requested regarding the Customer as the driver of the vehicle.
QNP Xperiences is not liable in any way for damage, theft or loss of any goods, property of the Customer or occupants.
It is the Customer’s responsibility to ensure that the rented motorcycle:
a) Is used in accordance with the manufacturer’s recommendations;
b) Is used in full compliance with the Legal Code of the countries in which it is travelling;
c) It will not be used negligently;
d) It will not carry more passengers than its authorised capacity allows;
e) It will not be used in races or competitions;
f) It will not be used for illegal purposes;
g) It will not carry more weight than its homologation allows;
h) It will not be used by anyone other than the Customers stated in the hire contract;
i) It will not be used if its mechanical condition is considered unsafe;
j) It will not be used after the consumption of drugs or alcohol or other illegal substances or above the required legal limit;
k) It will not be used when the customer’s physical condition is reduced due to fatigue or illness.
Failure to comply with any of the above implies immediate cancellation of the insurance and the customer’s liability for the full value of the motorcycle and accessories as new.
12. INSURANCE
Hire prices include compulsory civil liability insurance and damage insurance for theft, falls or collisions for damages above the excess, valid in Portugal.
In any case, the insurance conditions are cancelled and the Customer becomes liable for all damage to the rented motorcycle if:
a) The Customer leaves the scene of an accident in which they have been involved;
b) The Customer does not immediately report the theft or disappearance of the motorcycle or accessories to the Authorities and to QNP Xperiences;
c) The rented motorcycle is intentionally damaged by the Customer or by someone for whom the Customer is responsible;
d) The motorcycle is involved in an accident and the Customer fails to notify QNP Xperiences as soon as possible;
e) The motorcycle is ridden under the influence of alcohol, drugs or other narcotic substances;
f) The motorcycle is ridden in areas not authorised by QNP Xperiences, such as unpaved roads and racing circuits;
g) If it does not fulfil the requirements stipulated in point 11 of these Terms and Conditions, relating to Customer Responsibility.
13. SECURITY DEPOSIT & CREDIT AUTHORISATION
QNP Xperiences will not withhold a security deposit at the start of the hire period.
However, a debit authorisation is required on the Customer’s credit card (Visa or Mastercard network), to be processed when the bike is picked up.
This credit authorisation will be for up to €2,000, which corresponds to the amount the Customer is liable to pay in the event of being liable for damage, fines or the total loss of the vehicle.
The remainder is covered by the insurance, assuming that all the points mentioned in point 11 have been met.
If an insurance claim has been reported due to an accident, the entire authorised credit amount (€2,000) will be debited to the customer until the case is resolved. After the insurance company has carried out an expert opinion and determined liability, the customer will be reimbursed the remainder in the event of damage value is less than 2000€.
14. CONSUMABLES
The motorcycle is rented by QNP Xperiences with a full tank of fuel and must be returned in the same condition. If the motorcycle is returned without a full tank of fuel, a fee of €40 will be charged, plus the cost of the fuel needed to top up the tank.
The bike will be delivered by QNP Xperiences with tyres, brake pads and its general maintenance plan carried out by the official BMW Motorrad dealer network.
In the case of hire periods of more than 10 days, the customer is responsible for checking the oil level and brake pads and reporting any marked wear to QNP Xperiences.
15. TOLLS
All motorcycles in the QNP Xperiences fleet are equipped with an electronic identifier that allows them to pass through the respective toll gantries on the national road network (Via Verde) without stopping.
The toll is recorded electronically and debited to QNP Xperiences account up to 72 hours after passing through.
The use of this system is included in the rental and gives a 30 per cent discount on the toll.
At the end of the rental contract, QNP Xperiences will charge the Customer the tolls for the motorcycle they have used during the rental period. These amounts may not yet include the tolls for the last 72 hours, which, if any, will be communicated and debited to the customer at a later date.
16. KEYS
QNP Xperiences will hand over the keys corresponding to the operation of the motorcycle and luggage.
No duplicates will be supplied.
The Customer is responsible for the security of the keys during the rental period and must return all keys at the end of the rental.
QNP Xperiences is not responsible for any loss, theft or damage to the keys that may cause the rental period to be interrupted or terminated prematurely.
Loss of or damage to the key(s) will incur a key replacement fee of €350.
17. DOCUMENTATION
QNP Xperiences will provide all the documents required to drive the vehicle, namely a copy of the hire agreement, registration, proof of ownership and proof of insurance.
The Customer is responsible for this documentation during the hire period and must return all documents at the end of the hire.
The loss of any of these documents may incur a document replacement fee of up to €100 per document.
18. MECHANICAL FAILURE
In the event of a mechanical failure, the Customer must contact QNP Xperiences informing its location precisely and with detailed information about the failure.
If repair is necessary and possible, the Customer must obtain QNP Xperiences consent before carrying out such repair.
If repair is not possible, QNP Xperiences will endeavour to replace the faulty motorcycle as soon as possible.
QNP Xperiences will reimburse the rental amount corresponding to the period during which the motorcycle was immobilised due to the possible failure.
If replacement is not possible for any reason, QNP Xperiences will reimburse the Customer for the unused hire days.
QNP Xperiences is not responsible for time lost due to accidents or mechanical failures that may delay or stop the Customer’s holiday or travel plans.
In the event of mechanical failures caused by falls, accidents or negligent use by the Customer, the replacement motorcycle and reimbursement for immobilisation of the motorcycle are excluded.
19. PROCEDURE IN THE EVENT OF ACCIDENT OR DAMAGE
In the event of an accident or damage, the Customer is obliged to notify QNP Xperiences immediately by telephone.
Towing and/or repair services should only be called when QNP Xperiences agreement have been obtained.
The police and emergency services must be notified immediately in the event of an accident.
Evidence should be secured and an insurance declaration completed together with each of the other drivers involved.
Their names, addresses, telephone numbers, driving licence numbers and issuing authorities, vehicle makes, models, colours and number plates, as well as insurance details (insurance company and policy number) should be noted.
Witness contact details, braking marks and any information that contributes to the correct and complete clarification of the sequence of events should also be collected.
20. TERRITORY
Civil liability and damage insurance are valid in mainland Portugal.
If QNP Xperiences becomes aware of an unauthorised departure from the authorised territory, the contract conditions are violated, resulting in the immediate cancellation of the insurance and the customer’s liability for all damage and theft that may occur outside the territory authorised by QNP Xperiences, up to the total value of the motorcycle and accessories as new.
21. TRACKING
For security reasons, QNP Xperiences may install tracking devices on motorcycles.
Any attempt to dismantle or damage these devices will be reported to the authorities and punished in accordance with the penal code.
22. INTERNATIONAL ORGANIZATIONS
QNP Xperiences reserves the right to report breaches of contract to the Regulatory Entities it deems appropriate for the case in question, whether Portuguese, as from the Customer’s country of origin, or other entities within the European Union.
